Terms and Conditions
1. Services SendaDesign offers the following services:
- Web design and development
- PC and laptop repair & sales
- IT consulting
- Logo design
- Graphic designs
- Pyrography
2. Payment Terms
- For repairs, payment is due upon collection of the repaired product, unless otherwise agreed.
- For purchases of products under €500, the same rule applies: payment on collection unless otherwise agreed.
- For purchases of products over €500, a deposit of at least 30% is used unless otherwise agreed.
- Full payment in advance is required for the purchase of PCs, laptops and related accessories (such as monitors, keyboards, mice, software licences, etc.).
- The same conditions apply to the purchase of pyrography products.
- Invoices (with the exception of the above point) should preferably be paid within 14 days. In the event of non-payment or payment after 30 days, an administrative fee may be charged, plus an additional 10% late payment fee. In accordance with FPS rules.
- Invoices are issued electronically and sent by email, unless the customer indicates that they would prefer to receive them in a different format.
3. Quotations – Validity and Guide Price
All quotations prepared by SendaDesign are valid for 30 days from the date stated on the quotation form, unless expressly stated otherwise. After this period, the quotation automatically expires and can no longer be invoked, unless extended in writing by SendaDesign.
The amounts stated in the quotation are indicative. Taking into account price fluctuations among suppliers and the availability of parts or accessories, the final invoice amount may differ by up to 15% (more or less) from the original quotation.
In the event of significant deviations, the customer will always be notified in advance. In such cases, the customer has the option to review the quotation or cancel the order, provided that the cancellation conditions remain applicable.
4. Cancellation policy
- Websites: Cancellation is possible up to 1 month before the completion date, provided no work has yet been done. In case of cancellation, at least 30% of the quote will be charged.
- Logo design: cancellation is allowed up to 1 week before the completion date. Cancellation within the week of commitment will be charged at least 1 logo design.
- Repair Assignments: Cancellation must be made 1 week prior to the agreed upon date, with a charge of 1 hour. For cancellations later than 1 week, an additional hour will be charged per week started.
- PCs, laptops and accessories: SendaDesign does not work with standard stock, which means that every order is purchased and assembled to order according to the customer’s wishes. To avoid being left with unsold stock in the event of cancellation or changes, we work strictly to order.
If, for any reason, a customer decides to cancel the purchase within one week of accepting the quotation, a minimum charge of 30% of the total amount of the quotation, purchase receipt, invoice or till receipt may be applied. This charge covers administration, preparation costs, orders from suppliers, labour and any delivery costs.
SendaDesign reserves the right to increase this percentage if additional costs have been incurred as a result of the order.
5. Return policy Returns are only possible if it can be demonstrated that the product was already in poor condition upon delivery. Photographs and a description are required.
6. Shipments are only made at the explicit request of the customer.
- IT-products are delivered to your home by SendaDesign (unless otherwise agreed or stated). SendaDesign may charge a delivery fee for this, unless otherwise agreed.
- Pyrography products can be shipped on request, but shipping costs will apply. SendaDesign makes every effort to package the product properly, but cannot be held responsible for any damage during shipping. Products less than 1 cm thick will not be shipped; these can only be collected (or delivered to your home at an additional cost). Unless the customer explicitly requests this, in which case all responsibility lies with the customer and the customer will be informed about the packaging material and the shipping process.
7. Responsibilities SendaDesign is responsible for hosting (as a reseller of Combell) and the quality of the services provided. Customers are responsible for supplying content (photos and texts) and checking the website for any errors. Once the product or website is delivered and approved by the customer then the customer is responsible for the product/website and any kind of financial loss in any way cannot be assigned to SendaDesign.
8. Privacy and Data Protection SendaDesign operates in accordance with GDPR legislation and makes every effort to protect customer data. Personal data is collected for the purpose of providing services and may include:
- Name
- Email address
- Phone number
- Address
Cookies are used to increase usability, and customers can manage cookies through browser settings. Customers have the right to access, correct and delete their data.
9. Liability SendaDesign is not liable for damage that cannot be attributed to it. Damage caused by third parties falls outside the responsibility of SendaDesign.
10. Applicable Law The agreement is governed by the GDPR and the laws of the Commercial Court of Ghent.
11. Guarantees SendaDesign only delivers projects after extensive testing and approval by the customer.
12. Use of the Website and Services Inappropriate content on websites developed or hosted by SendaDesign may result in the removal of the website. Use of the SendaDesign logo is only permitted with express approval.
13. Security Plan / Security Plan Pro (Managed security)
SendaDesign offers the optional Security Plan and Security Plan Pro services. These are managed security services whereby SendaDesign installs a security solution on the customer’s devices and monitors it via a central management platform.
13.1. What is included
- Installation and activation of the security software on the agreed number of devices (“seats”).
- Assigning settings (policies) per customer/device, depending on the chosen plan.
- Follow-up of warnings/alerts and basic operational checks.
- Adjustments to settings where necessary (e.g. exceptions or stricter security), in consultation with the customer.
13.2. Best efforts obligation
- Security Plan (Pro) is a best-efforts commitment: SendaDesign will do everything necessary to correctly install, configure and monitor the security measures.
- There can never be a guarantee that a device will not become infected or that every incident can be prevented.
- Cyber threats (phishing, malware, hacking, ransomware, fraud) are constantly evolving and can never be completely ruled out.
13.3. Customer responsibilities
The customer remains responsible for:
- the safe use of the device (links, downloads, attachments, unknown software);
- keeping passwords and accounts confidential;
- the timely reporting of suspicious situations or incidents;
- providing a backup of important files (photos, documents, accounts, etc.).
SendaDesign cannot be held responsible for damage caused by the lack of backups.
13.4. Access and cooperation
- Installation, management or interventions may require (temporary) access to the device (remotely or on site).
- If this access is not possible or cooperation is lacking, SendaDesign cannot guarantee the proper functioning of the service.
13.5. Liability and limitation
SendaDesign cannot be held liable for:
- loss of data, documents, photographs, emails, accounting records, or other files;
- financial damage, loss of turnover, loss of profit, damage to reputation or consequential damage;
- damage caused by cyber incidents such as malware, ransomware, hacking, phishing, fraud or data breaches;
- damage caused by third-party software, operating system updates or hardware/network defects.
In any case, SendaDesign’s liability is limited to the amount that the customer actually paid for the Security Plan service during the current subscription period.
13.6. Licence, devices and discontinuation
- The service applies per device (“seat”). The number of secured devices is limited to the agreed number.
- When replacing a device (new PC/laptop), the security can be transferred, provided that the number of seats is respected.
- In the event of termination or non-payment, SendaDesign may suspend or terminate the service. In that case, the right to management/follow-up will lapse.
- Subscriptions that have already been paid for will not be refunded, unless otherwise agreed in writing.
13.7. Privacy
SendaDesign uses this data solely for the purpose of providing the service and treats it in accordance with the privacy statement.
